This agreement describes the terms and conditions applicable to your use of our services at LeetSpeak.com.au. By accessing, viewing, using or downloading materials from this web site, you agree to be bound by these terms.
In this agreement, “we” mean LeetSpeak. “you/users” means the members and/or clients, as the context requires. This site means LeetSpeak.com.au Internet web site.
We may revise this agreement at any time by posting revised terms on this web site. Such revised terms take an immediate effect unless specified. Please note that it is your responsibility to check this agreement periodically.

Disclaimers
This site is to provide information and services from LeetSpeak. Information on this site may contain factual inaccuracies or typographical errors or be incomplete or out of date. LeetSpeak may make changes and/ or improvements in the products described in this site at any time without notice. LeetSpeak has no control over or responsibility for the accuracy, legality and safety of postings made by users. We do not underwrite or guarantee those Services and in particular we exclude any implied warranties as to qualifications, background, and fitness for purpose. Regarding any communications with other users on this site, including the development and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such agreements, LeetSpeak is not liable for any loss or damage of any kind. We are not liable for any loss or damage for contracting virus in consequence of visiting this site.

Use of Voice Communication
By virtue of using our service, you agree to use the service as is provided. You may not, under any circumstances, resell your service or add unauthorized slots or servers, to your server. Further, by accepting a service through LeetSpeak, thus agreeing to this TOS, you agree that we will not be held liable for any takeover of your server by any outside, unauthorized, 3rd party. Contravention of any part of this TOS may result in an immediate termination of service without redress to a refund.

Use of Forum Services & Acceptable Use Policy
Leetspeak provide their customers with a pre-installed forum by request, usually after a small setup fee. Wether or not a setup fee is charged, the forum has rules and an Acceptable Use Policy (AUP) that must be adhered to. Leetspeak provided forums may be shut down or restricted if in any month period, if receives excess activity, mesasured in topics posted. 60 is considered excess and may result in termination or suspension of the forum in question. In addition, bandwidth and disk space will be monitored, should disk space exceed 100MB or bandwidth exceed 10GB per month, the forum owner may be approached to reduced this impact to our services, failure to adhere to these requests may result in the forum service being suspended or terminated. At no time is any malicious or dangerous software to be uploaded to the forum, doing so will result in immediate forum service termination, what is considered malicious or dangerous is to the discression of Leetspeak.

Forum Support and Backups
Please be advised that support of provided forums is not supported by Leetspeak but by the developers. All questions/issues with their software must be taken to them directly. In the event of lost data or corruption, Leetspeak can provide a restore and refresh of your forum from a backup for a fee of $35, backup may be up to a week old.

99.9% Uptime Guarantee
LeetSpeak offers a 99.9% Uptime Guarantee. That means your server is guaranteed to be operational 99.9% of the time each individual month. This guarantee allows for 40 minutes of server outage per month as defined in this document. For any downtime past the agreed upon 40 minutes, we will, at the customers request, refund their most recent months payment. Regardless of the number of outages, all refunds are limited to one month's fees.
Note – For the purposes of this guarantee, downtime will only be considered for service outages that last for 1 minute or longer and do not include outages resulting from scheduled nightly backups and non- LeetSpeak processes or infrastructure. .

Bandwidth
As a Scalable Voice Communications provider, LeetSpeak’s bottom line is determined partially by the amount of bandwidth customers utilize. We can normally balance that cost and utilization while continuing to provide great service to all customers. Customers will not be charged for the bandwidth consumed, nor do we have specific limits or caps on that bandwidth. However, if you utilize any of your LeetSpeak’s services in a manner which consumes excessive bandwidth or affects our core equipment, overall network performance, or other users' services, LeetSpeak may require that you cease or alter these activities. Under no circumstances is there to be any type of continuous broadcasting such as radio stations, music, etc. LeetSpeak reserves the right to cancel servers and accounts without notice or compensation if the terms outlined above are not adhered to.

Penalties
Without limiting any other remedies available to us we may at any time on notice to you with immediate effect terminate our obligations to you under this agreement and prohibit your future use of this web site if you have engaged in any unlawful or improper activities in relation to your use of our services at this web site or if you breach any of the terms of this agreement.

Limit of our Liability
We are not liable to you for any indirect or consequential loss or damage from your use of our services at this web site.

Severance
In the event that any term of this agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Account Cancellation
LeetSpeak may cancel your account immediately and remove all data from your service in the event of non payment. This includes situations where your payment method is severed through credit card denial or paypal subscription cancellation.
Where you, the customer, cancel your account by request, you willingly forfeit any remaining days of service paid for.

Refund Poliy
Servers that do not meet your expectations must be cancelled within fifteen (15) days of purchase.
If you are not satisfied with the operation of your service, or any aspect of our product or service, you can request, and will receive a partial refund for the days of the billing month that were unused.
This does not preclude our right to offer refunds outside of this time period if the situation warrants. We treat all our clients EXACTLY the same way we would expect to be treated.

Delivery Policy
If for any reason, you do not receive the required information, or you receive it and it isn’t set up properly, you may submit a request for us to fix it via our 24/7 support system. The support system can be found within the Support section of our website. You may also email support@LeetSpeak.com.au.

Privacy Policy

Privacy on the Internet
This privacy statement is applicable to all LeetSpeak web-sites and customer databases.
LeetSpeak respects the privacy of its Internet users and will protect that privacy as vigorously as possible.
LeetSpeak does not collect information that personally identifies individuals except when individuals provide such specific information on a voluntary basis. There may be occasions where specific personal information is requested before an individual can enter certain sections of the LeetSpeak site. For example, information is needed to order a voice communication server or to participate in any LeetSpeak forums. This kind of registration helps us to ensure that content standards on these sections of the site are rigorously upheld or that contact can be made with clients as needed by us.
In all such cases, LeetSpeak will collect only information that is voluntarily provided by the user and undertakes that such information will be kept strictly confidential. Individual information provided to LeetSpeak to gain access to any of its sites will not be sold or made available to a third party.
LeetSpeak does reserve the right, however, to perform statistical analyses of user behaviour and characteristics, in order to measure interest in and use of the various sections of its sites so as to improve design and navigation and to gather marketing information for our own use. Only aggregated data from these analyses, not individual data, will be used for this purpose.
As well, users should be aware that certain non-personal information and data may be automatically collected by LeetSpeak through the operation of what are called "cookies". "Cookies" are small text files that identify an individual computer's browser entering a web site. They allow the site to track that browser's movement through the site over several sessions. Through cookies, a web site can recognize repeat users, facilitate the user's access to and use of the site and allow a site to track usage behaviour that will allow content improvements. LeetSpeak uses cookies only for the above-mentioned purposes and will not use them to identify users or to track non-LeetSpeak usage.
If you do not want a cookie placed on your computer by LeetSpeak, you may disable cookies altogether by modifying the Preferences section of your Firefox or Internet Explorer browser (under Edit/Preferences/Advanced). Note that it is possible that some aspects of LeetSpeak sites may be unavailable to you if you choose this option.
If you have no problem accepting cookies, but wish to be informed of their appearance, you may turn on a warning prompt by modifying the cookie warning section in Edit/Preferences/Advanced.

Limiting Collection
The collection of personal information shall be limited to that which is necessary for the purposes identified by the organization. Information shall be collected by fair and lawful means.
